Bethesda unable to block Interplay's Fallout titles
Court allows interplay to push on
Bethesda has been denied its initial motion to stop sales of Interplay's Fallout 3-pack bundle for the PC. The court battle is not over, but for now Interplay is in the clear on pushing its product.
The lawsuit was filed earlier in the year and also concerns Interplays rights to create a Fallout MMO. It seems that when Bethesda originally bought the rights to the series they did license the MMO, but thats it, now they claim that Interplays distribution of the bundle containing three games that were the original installments of Fallout back in the day.
Bethesda complain that Interplay is infringing upon their licensing agreement and that the bundle is too confusingly similar to Bethesdas Fallout 3. The court did not release its reason for the decision and there was nothing yet regarding the MMO.
