Midway have this week confirmed a 33 million USD bid from for the embattled game publisher, the offer for the majority of the maker being considered by the courts.

An agreement is being considered that would see Bros bagging all of Midway's assets, such as the Mortal Kombat license and studios in Chicago and Seattle.

The deal, however, does not cover the firm's San Diego outfit, not their TNA franchise games. Newcastle - creators of Wheelman - are also said to be left out in the cold by the proposed purchase.

Midway is currently under bankruptcy protection, US courts to decide the company's future, while a purchaser is desperately sought to keep the firm alive.
