Game makers Genius Products and Numark Industries are taking on he might of gaming giant over unreleased game Scratch: The Ultimate DJ.

The firms allege that Activision conspired to prevent the release of the game in order to give their own release a commercial advantage; a clear run at the new audience the game looks to appeal to.

Apparently, Activision had originally tried to buy the rights to Scratch, and were refused by Genius, but then went on to throw another spanner in the works by buying 7 Studios - the developer actually making Scratch.

7 Studios were still under contract to Numark and Genius at the time of the purchase - with non-disclosure and confidentiality agreements in place, and the companies are feeling somewhat hard done by as a result.
