Activision is claiming publishing rights to Brutal Legend, developed by Double Fine.

It was previously thought that had no interest in picking up the Vivendi games title, after merging with company last year.

Variety now reports that Activision has written a letter to EA, who are now planning to release the game, informing them of "legal concerns".

An representative commented: "We doubt that Activision would try to sue. That would be like a husband abandoning his and then suing after his wife meets a better looking guy."
